إجراءات رفع الحصانة عن النواب وفق النظام الداخلي للجمعية الوطنية

نص النظام الداخلي للجمعية الوطنية (البرلمان) على أنه يمكن رفع الحصانة البرلمانية على أساس طلب مقدم من الوزير المكلف بالعدل مرفقا بملف القضية، يوجه إلى رئيس الجمعية الوطنية.

 

ووفق المدة 86 من النظام الداخلي للجمعية الوطنية: "تتم دراسة كل طلب لرفع الحصانة البرلمانية من قبل لجنة مشكلة بالمناسبة، مؤلفة من 13 عضوا يتم اقتراحهم من طرف رؤساء الفرق البرلمانية وفق مبدإ النسبية المحدد في المادة 4 من هذا النظام الداخلي. وتستدعى اللجنة فور تشكيلها من طرف رئيس الجمعية الوطنية لانتخاب رئيسها ومقررها وفق الإجراءات المحددة في المادة 32 أعلاه المتعلقة بانتخاب مكاتب اللجان الدائمة".

 

ووفق المادة نفسها: "لا يجوز لأي نائب لا ينتمي إلى هذه اللجنة حضور أشغالها إلا للإدلاء بشهادة أو للإجابة على أسئلة اللجنة، وفي حدود المدة الضرورية لذلك".

 

وتنص المادة نفسها على أنه: "تستمع اللجنة المشكلة بالمناسبة للنائب المطلوب رفع الحصانة البرلمانية عنه، أو لأحد زملائه إن عينه لتمثيله".

 

وحسب الفقرة الأخيرة من المادة 86 من النظام الداخلي للجمعية الوطنية: "يحال تقرير اللجنة المشكلة بالمناسبة، مرفقا - عند الاقتضاء - بمذكرة بدفاع النائب المطلوب رفع الحصانة عنه، إلى مؤتمر الرؤساء لإبداء رأيه بشأنه قبل إدراجه على جدول أعمال أقرب جلسة للجمعية الوطنية".

 

ووفق المادة 87 من النظام الداخلي للبرلمان: "تتخذ الجمعية الوطنية  القرار المتعلق برفع الحصانة البرلمانية في جلسة عامة لا تقرأ خلالها سوى خلاصات تقرير اللجنة المشكلة بالمناسبة".

 

ووفق الفقرة الثانية من نفس المادة: "يصادق على قرار قبول أو رفض طلب رفع الحصانة البرلمانية على شكل توصية من الأغلبية المطلقة للنواب المشكلين للجمعية الوطنية".

 

وتنص الفقرة الثالثة من نفس المادة على أنه: "لا ينطبق هذا القرار إلا على المخالفات التي تم بموجبها طلب رفع الحصانة البرلمانية. وفي حالة الرفض، لا يمكن استقبال طلب رفع حصانة يتعلق بنفس الوقائع ونفس الشخص خلال نفس الدورة".
