المحكمة العليا تعلق قرارا لعمدة السبخة يلغي عقود تسيير السوق

أصدرت الغرفة الإدارية بالمحكمة العليا أمرا بتعليق قرار صادر عن عمدة السبخة با إسماعيل عيسى، يلغي عقود تسيير السوق الموقعة من طرف العمدة السابق أبو بكر سوماري. 

وجاء في نص قرار العمدة با إسماعيل عيسى الموجه إلى التجار بالسوق المركزي في البلدية: «نبلغكم بأن العقود الموقعة من طرف العمدة المنتهية صلاحية لاغية وغير معتبرة».

وألغت الغرفة الإدارية بالمحكمة العليا قرار عمدة السبخة بعد عريضة مقدمة من طرف الأستاذين أحمد ولد اعلي واباه ولد امبارك، وأمرت بـ «تعليق نفاذ القرار محل الطعن إلى أن تلتئم غرفة المشورة».

وعللت الغرفة أمرها بأن البلدية أبلغت بالعريضة ولم ترد في الأجل المحدد، وأن غرفة المشورة غير جاهزة لتلتئم في الوقت الراهن، وأن استمرار تنفيذ القرار قد يحدث وضعية لا يمكن تداركها، إضافة إلى الطابع الاستعجالي للقضية.
