محكمة الحسابات تفتح النار على تسيير الأمين العام السابق لوزارة الأسرة والطفولة والعمل الاجتماعي

وصف  التقرير الصادر عن محكمة الحسابات( 2019-2020-2021) اللجنة الداخلية للصفقات والعقود في وزارة الشؤون الاجتماعية و الطفولة والأسرة،  بالضعف وبمحدودية التدخلات.

بينما رفضت المحكمة تبريرات الأمين العام السابق للوزارة، واعتبرت أن ماقدمه من أسباب  لايمكن أن يبرر التجاوزات المسجلة، وهذه أهم المآخذ في تسيير الوزارة خلال تلك الفترة حسب المحكمة:

أولا: ملاحظات حول التسيير

- موافقة غير مبررة على عقود التراضي 

- اسناد مهمة اختيار مقدم خدمة للجنة أخرى 

- خطأ في تحميل بعض النفقات 

- تجزئة الطلبات، تفاديا للوصول إلى سقف اختصاص لجنة الصفقات بالوزارة.

- عقد حصري مع عيادة خاصة، حيث حصلت العيادة على 45% من مخصص التكفل بمرضى العجز الكلوي.

- عقد غير شرعي لاختيار مقدم خدمة( مكتب تإرشاد للاستشارات من أجل القيام بدراسة جدوائية بنك الأسرة) خلافا لمقتضيات مدونة الصفقات العمومية.

- عقد بالتراضي لاختيار مقدم خدمة، مع مكتب proof من أجل تكملة إعداد المنصة الرقمية للكفاءات النسوية.

ثانيا: القروض

- تعاقد بالتراضي  مع مؤسسات التمويل، واستحوذت مؤسسة وحيدة على 18 اتفاقية من أصل 25، ما يعني غياب المنافسة في اختيار مرسسات التمويل، مايمثل مخالفة صريحة لمقتضيات المدونة.

- عدم متابعة التنفيذ، فلم يتم الحصول على تقرير واحد عن مهمة لمتابعة التنفيذ، والوزارة لم تقم بأي مهمة من أجل الوقوف  على حقيقة سير هذه المشاريع.

- ضعف عمليات التحصيل، مع غياب الضمانات من مؤسسات التمويل ومن المستفيدين، وذكرت المحكمة أنه لوحظ غياب وضعية التحصيل فيما يتعلق باتفاقية التمويل بين مؤسسة قرض نواكشوط، لصالح 60 من ذوي اإعاقة الدائمة.

- الصرف خارج المساطر القانونية: لوحظ أن المبالغ التي يتم تحصيلها من طرف مؤسسات التمويلات الصغرى، لايتم استرجاعها لحساب الوزارة.

في المقابل يتم صرفها لحاجات الوزارة بأمر من الأمين العام.

- عدم مواكبة المفتشية الداخلية للوزارة لعمليات توزيع القروض، فلم تسجل أي تدخل رقابي.

* الإعانات:

- عدم استرداد مبالغ من مؤسسة قرض

وتقجمت المحكمة بموعة من التوصيات من ضمنها: 

- التوقف عن عقود التراضي غير المبررة.

- تفعيل لجنة الصفقات الداخلية حتى تضطلع بصلاحياتها بكل حياد

- إعادة النظر في العقود الموقعة مع العيادة الخاصة
